Employer Vaccine Mandates: What Your Business Needs to Know

Since early September, when the White House directed the Occupational Safety and Health Administration (OSHA) to develop an Emergency Temporary Standard (ETS) implementing new COVID-19 vaccine and testing mandates for many employers, questions about these pending requirements have been myriad but answers have been hard to come by. Now that the ETS has been approved and issued, America's job creators are sifting through its contents to find the answers they've been seeking.

Labor Commissioner Josh Dobson, with discussion moderated by Ray Starling, general counsel with the NC Chamber and president of the NC Chamber Legal Institute.

Key Considerations for NC Employers

• ETS mandates all private-sector employers with at least 100 employees to require either COVID-19 vaccinations or weekly testing for all employees, among other requirements

• Federal rule effective once added to the Federal Register, remains in place for six months, after which a permanent rule must be proposed and approved 

• N.C. DOL has 30-day time window from ETS issuance to adopt federal rule or propose an equally or more stringent state standard, giving NC employers more time to comply
